BOOST Program Terms and Conditions of Use

Article 1 - Purpose of the Program

This document defines the rules and conditions applicable to the affiliate program offered by TPOP. By joining this program, the Affiliate agrees to promote TPOP's products and/or services in accordance with the terms and conditions described below and undertakes to comply with all the provisions of theseTerms and Conditions.

Article 2 - Membership and eligibility

  1. Membership:
    Any individual or legal entity wishing to participate in the affiliate program must register via the dedicated form and provide accurate and verifiable information.
  2. Eligibility:
    Only registrations validated by TPOP will give access to the program. TPOP reserves the right to refuse any application for membership, without obligation to justify its decision.

Article 3 - Operation and validation of Commissions

Commission mechanism:
The affiliate receives a fixed commission of €15 for each new subscriber who takes out a paid subscription via the affiliate link.

Win validation :

  • Subscription duration condition: The commission is validated only after the subscriber has maintained a paid subscription for at least 1 month and 1 day.
  • Correct use of the link: Only subscriptions made following full and correct use of the affiliate link provided will be eligible for commission. Cases where the user visits the site without having clicked on the link or by manually modifying the URL will not be considered.

One-off commission:
Commission is paid only once per validated subscriber. No recurring commission will be granted on the same subscription, even in the event of renewal.

Article 4 - Terms of payment

Minimum payment threshold:Commission payments are only triggered when the cumulative total reaches at least €65.

Periodicity and Terms of Payment :

  • Payments are made according to a pre-established schedule (monthly or quarterly, for example) after verification of the validity of subscriptions and compliance with the conditions of article 3.
  • TPOP reserves the right to suspend or postpone payment in the event of doubt as to the validity of commissions or in the event of proven fraud.

Banking and Tax Information:
It is the Affiliate's responsibility to provide accurate PayPal contact information and to keep their tax information up to date. All payments will be made on the basis of the information provided by the Affiliate at the time of registration.

Article 5 - Use and Distribution of Affiliate Links

Appropriate use: The affiliate undertakes to use the affiliation link(s) exclusively on media related to its activity or its promotion of the service. It is imperative that the link(s) be distributed responsibly and in accordance with good digital marketing practice.

Prohibition of Spam and Improper Distribution:

  • No Spam: It is strictly forbidden to insert affiliate link(s) in spaces or platforms where their presence is not relevant (e.g. comments on unrelated blogs, forums or social networks, unsolicited mass e-mailings, etc.).
  • Abusive distribution: Any repeated and abusive distribution of the link, or any attempt to artificially inflate the number of clicks via fraudulent means (for example, by automated scripts or spam techniques), will be considered a serious breach of these conditions.

Preservation of Link Integrity: The Affiliate shall not modify or hide the original URL provided by TPOP. Any unauthorized alteration, shortening or redirection of the affiliate link will not be recognized as valid for commission validation.

Control and Sanctions: TPOP reserves the right to monitor the manner in which affiliate links are used. In the event of non-compliance with these provisions, TPOP may :

  • Delete or request the deletion of any content containing links distributed in violation of these conditions.
  • Retroactively cancel commissions generated by these practices.
  • Immediately suspend or terminate the affiliation contract without notice or compensation.

Compliance with the rules of third-party platforms: The Affiliate is also required to comply with the terms of use and rules of the platforms on which it distributes its link. In the event of a conflict between these rules and the present conditions, the Company reserves the right to take the necessary measures to protect its interests and those of the affiliate program.

Article 6 - Obligations and Prohibitions of the Affiliate

  1. Use of the Affiliate Link:
    The Affiliate undertakes to use only the Affiliate Link provided and not to modify it.
  2. Loyal and Respectful Promotion:
    Any fraudulent or deceptive method of promotion (for example, artificially inflating statistics through unqualified clicks or malicious redirects) is strictly forbidden.
  3. Responsibility:
    The affiliate is solely responsible for the distribution of its affiliate link, and must ensure that all promotional material complies with current regulations (particularly with regard to advertising and the protection of personal data).

Article 7 - Liability and Limitations

  1. Verification and Control: TPOP reserves the right to check and verify the validity of each subscriber registration made via the affiliate link.
  2. Suspension and retroactivity: In the event of non-compliance with these provisions (for example, fraud, misuse of the link or modification of the URL), TPOP may retroactively cancel the commissions related to the subscriptions concerned.
  3. Program modification: TPOP reserves the right to modify the program conditions (including commission amount, payment terms and minimum threshold) at any time without prior notice, while guaranteeing affiliates the commissions validated prior to the modification.

Article 8 - Payment and validation period

  1. Commission validation period : The commission will be considered definitively earned only after verification of the user's subscription period. Only subscriptions confirmed after a period of one month and 1 day will give rise to the payment of commission.
  2. Claims: The affiliate will not be able to claim commission for a user who has not complied with the subscription conditions (for example, if the user has cancelled his subscription before the end of the validation period, or if he has not used the affiliate link correctly).

Article 9 - Modification and Termination

  1. Modification of Terms : TPOP may modify these Terms at any time. Affiliates will be notified of any changes and continued membership in the program will constitute tacit acceptance of the new terms.
  2. Termination of the Affiliate Contract: In the event of repeated or flagrant non-compliance with these conditions, TPOP reserves the right to immediately terminate the Affiliate's participation in the program, without compensation and without prejudice to any action for damages.

Article 10 - Applicable law and jurisdiction

The present Terms of Use are governed by French law. Any dispute relating to their interpretation or execution shall be submitted to the competent courts of Nîmes.
